Government Inquiry Decision Awaited
The Supreme Court has granted additional time for the government to decide whether it will continue the inquiry commission formed to investigate audio leaks. On November 22, the Constitutional Bench directed the government to clarify its stance on the matter. The commission, established to verify the authenticity of leaked audios, has been inactive since its last hearing on May 27, 2023.
Hearing Developments
At the latest hearing, Additional Attorney General Aamer Rehman requested a brief delay, citing recent political unrest in Islamabad as the reason for the government’s inability to present the issue in cabinet meetings. The court was assured that the matter would be tabled in the next cabinet session, with updates provided thereafter.
IHC Orders on Surveillance
Previously, the Islamabad High Court (IHC) had prohibited telecom companies from recording phone calls and data for surveillance, citing the Fair Trial Act. This order significantly impacted intelligence and law enforcement agencies, limiting their ability to monitor crimes. However, subsequent rulings permitted limited data sharing for post-crime investigations while curbing mass surveillance by telecom operators.
The case remains under scrutiny as the government reviews its position on the inquiry commission’s role and responsibilities.
