On Wednesday, Apple and Google app stores blocked access to DeepSeek, a Chinese artificial intelligence app. This action came just a day after Italy’s data protection authority raised concerns about the app’s handling of personal data.

Background on DeepSeek

Last week, DeepSeek launched a free AI assistant that claims to utilize less data while offering services at a fraction of the cost compared to existing alternatives. Notably, within a short span, the app garnered significant popularity, even surpassing the U.S. rival ChatGPT in downloads from the Apple App Store. This surge in popularity alarmed investors in the tech stock market.

Investigation by Italian Authorities

The Italian data regulator, known as Garante, is leading an investigation into DeepSeek’s data processing practices. The head of the Italian data regulator, Pasquale Stanzione, commented on the recent withdrawal of the app, stating, “The news of the withdrawal of the app was only a few hours ago; I cannot say whether it is due to us or not.” He further indicated that the Garante would conduct a thorough investigation to ensure compliance with the General Data Protection Regulation (GDPR).

The Garante has specifically requested information regarding the personal data collected by DeepSeek, including:

  • Sources of Data: Where the data is obtained from.
  • Purpose of Data Collection: Why the data is being collected.
  • Legal Basis: The legal justifications for data processing.
  • Data Storage: Whether the data is stored in China.

The authorities have given DeepSeek and its affiliated companies a deadline of 20 days to respond to these inquiries.

Safeguards for Users

In addition to investigating data handling practices, the Garante is focusing on ensuring the safety of underage users accessing the app. They are looking for reassurances regarding the protection of minors, avoidance of bias in data processing, and prevention of electoral interference through AI applications.

Availability of DeepSeek

Despite the restrictions in Italy, users who previously downloaded the DeepSeek app can still access its features. The app remains available for download and operational in other European Union countries and the UK. However, a notice on the Italian Apple App Store indicated that the app is “currently not available in the country or area you are in.” Google’s app platform announced that it does not support the download in Italy.

Monitoring by Other Countries

In Germany, the government is keeping a close watch on AI applications due to concerns about potential interference, especially with the upcoming national elections on February 23. An interior ministry spokesperson highlighted the worries regarding AI’s ability to manipulate or influence public opinion during this crucial period.

Conclusion

Recognized as one of Europe’s most proactive regulators concerning AI usage, Italy’s Garante takes significant action. Recent actions taken against DeepSeek echo similar measures from two years ago when authorities briefly banned the use of Microsoft-backed ChatGPT over suspected violations of EU privacy regulations. As the investigation into DeepSeek unfolds, it underscores the increasing scrutiny and regulation surrounding AI applications and their impact on personal data protection.
